1. AGREEMENT TO TERMS

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and Heal Tree LLC, doing business as Heal Tree Hemp (“Heal Tree,” “Company,” “we,” “us,” or “our”).

These Terms govern your access to and use of www.healtreehemp.com, www.healtreecbd.com, our online store, and any other website, webpage, service, feature, or application operated by Heal Tree LLC that links to these Terms (collectively, the “Site”).

By accessing or using the Site, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies incorporated into these Terms, including our Privacy Policy, Shipping Policy, and Refund/Return Policy.

2. AGE REQUIREMENT

You must be at least 21 years of age to purchase hemp-derived cannabinoid products from Heal Tree.

This is Heal Tree’s company policy regardless of whether a particular jurisdiction establishes a lower minimum age for a particular product.

By placing an order, you represent and warrant that:

You are at least 21 years old;

Any age or identity information you provide is truthful and accurate;

You are legally permitted to purchase, possess, and receive the products ordered at the delivery location; and

You are purchasing products only for lawful purposes.

We reserve the right to require government-issued identification or other information to verify your age and identity.

We may use third-party age- or identity-verification services. By purchasing or attempting to purchase an age-restricted product, you authorize Heal Tree and its service providers to use information you provide for age verification, identity verification, fraud prevention, order processing, and legal compliance, subject to our Privacy Policy.

We reserve the right to refuse, hold, or cancel an order if we cannot verify your age or identity.

Attempting to circumvent our age-verification procedures or providing false age or identity information is prohibited.

3. HEMP AND CANNABINOID PRODUCTS

Heal Tree reserves the right to:

By purchasing or consuming cannabinoid products, you acknowledge that certain products may affect judgment, coordination, reaction time, alertness, perception, or other physical or mental abilities.

Do not provide cannabinoid products to anyone under 21 years of age.

Keep all cannabinoid products securely stored and out of the reach of children and pets.

5. DRUG TESTING

Use of hemp-derived cannabinoid products may result in a positive drug test, including products marketed primarily as containing CBD or other cannabinoids.

Heal Tree does not represent or guarantee that any product is “drug-test safe” or that use of a product will not result in a positive drug-screening result.

You are responsible for considering any employment, athletic, military, probation, medical, licensing, or other drug-testing requirements that may apply to you before using a cannabinoid product.

6. HEALTH AND PRODUCT DISCLAIMER

Products sold by Heal Tree are not intended to diagnose, treat, cure, or prevent any disease unless expressly authorized for such use by the appropriate governmental authority.

Information provided through the Site, product descriptions, marketing materials, customer reviews, educational content, employee recommendations, social media, or other communications is provided for general informational purposes and is not intended to constitute medical advice.

Heal Tree does not diagnose medical conditions or prescribe medical treatment.

You should consult an appropriate healthcare professional before using cannabinoid products, particularly if you:

Cannabinoid concentrations may vary by product and batch. Statements regarding THC or other cannabinoid concentrations should be understood as applying to the specific product or batch to which the information relates and not necessarily to every product sold by Heal Tree.

If you believe there is a material discrepancy between a product and the information displayed on the Site, contact Heal Tree before using the product.

8. SHIPPING RESTRICTIONS

Due to varying federal, state, and local laws governing hemp and hemp-derived cannabinoid products, certain products may not be available for shipment to every jurisdiction.

Shipping availability may vary based on:

Product type;

Cannabinoid content;

Cannabinoid concentration;

Product form;

Intended use;

Customer age;

Delivery location; and

Applicable law or regulation.

For example, shipping restrictions applicable to a CBD product may differ from restrictions applicable to THC gummies, THCA flower, pre-rolls, or other cannabinoid products.

Heal Tree reserves the right to restrict, refuse, or cancel shipment of any product to any state, territory, locality, or other jurisdiction when we determine that the sale, possession, shipment, or delivery of the product may be prohibited, restricted, or otherwise inappropriate under applicable law, regulation, carrier policy, payment-processing requirement, or Company compliance policy.

The fact that a product appears on the Site or can initially be added to an online shopping cart does not guarantee that the product can be shipped to your location.

Current product-specific shipping restrictions may be displayed on our Shipping Policy, Shipping Restrictions page, product page, or during checkout.

Shipping restrictions may be updated from time to time in response to changes in laws, regulations, enforcement policies, carrier requirements, payment-processing requirements, or Heal Tree policies.

If an order contains a product that we determine cannot be shipped to the delivery destination, Heal Tree may:

Pricing errors;

Product listing errors;

Failed payment authorization;

Suspected fraud;

Chargeback history;

Failed age or identity verification;

Shipping restrictions;

Legal or regulatory restrictions;

Purchase quantity restrictions;

Payment-processor requirements;

Carrier restrictions; or

Other legitimate business, compliance, or safety reasons.

We may limit purchases made by the same customer, household, account, credit card, billing address, shipping address, or other identifying information.

We may also limit or prohibit orders that appear to have been placed by unauthorized dealers, distributors, or resellers.

If Heal Tree cancels an order after collecting payment, we will refund the applicable amount as required by our Refund/Return Policy and applicable law.

You agree to provide current, complete, and accurate information when placing an order or creating an account.

You are responsible for ensuring that your:

Billing address;

Shipping address;

Email address;

Telephone number;

Payment information; and

Age- or identity-verification information

are accurate and current.

You authorize Heal Tree and its payment-processing providers to charge the payment method you provide for your purchase, including applicable taxes, shipping charges, and other disclosed fees.
